Go Cycling Portugal - Bike Rental Agreement

OVERVIEW

The customer hereby rents bicycles from OAK, unipessoal lda ( proprietary of the “Go Cycling Portugal” brand), subject to all terms and conditions of this agreement:

  1. “Go Cycling Portugal” rents bikes only with prior booking, completed online on it's website https://gocyclingportugal.com . Rental day period starts at 9:00 h and ends at 18:00 h. Overnight rentals can be agreed with “Go Cycling Portugal”;

  2. The rented equipment will be delivered and collected to/from the bike stations listed on Go Cycling Portugal's websites, or any other place previously appointed with Go Cycling Portugal. Delivery and pick‐up of bicycles can be requested from Portugal. Delivery and pick up of bikes in different bike stations will carry a charge pre‐set of 60EUR per bike. 

  3. The bicycles will be delivered and picked up on the day and time according to the booking or rental agreement. Customer delays, both on delivery and pick up of bikes, without notifying Go Cycling Portugal, will result in an additional charges if delivery & pick up service must be re‐programmed plus the corresponding delivery and pick up charge. 

  4. At the end of the rental period the customer must return the bicycles to a “Go Cycling Portugal” representative identified with the original rental contract form or properly identified hotel attendants.

  5. The client acknowledges that “Go Cycling Portugal” will do its best to deliver and pick up from locations at agreed upon times, but force majeure or other exceptional circumstances (unusual traffic en route to drop‐off or delivery) may cause delays. The client agrees to adhere to delivery and pick‐up times themselves and authorize “Go Cycling Portugal” to charge their credit card if meeting times are not met and additional expenses are incurred due to renter lateness (i.e. staff time, highway tolls, etc.). If there are changes to the pick‐up location or time once the rental has started this must be communicated by confirmed email or direct telephone contact at least 48 hours before the bicycles are returned to “Go Cycling Portugal”. 

RESERVATION, PAYMENT, DEPOSIT 

  1. Bike reservations must be done with enough anticipation in order for “Go Cycling Portugal” to confirm availability, however if the customer needs a bike on the same day he/she may call (+351935094597) to check for availability. The customer can check for availaiblity and reserve a bike online at Go Cycling Portugal's website or by emailing info@gocyclingportugal.com

  2. Method of payment: Payment for the rented items is required to be made in full prior to the delivery date, online at “Go Cycling Portugal” web page or upon delivery of the bikes. Instructions on how to use this service are available on the same web page. The reservation is only confirmed once Go Cycling Portugal has confirmed receipt of the payment via E‐mail. 

  3. The customer signing the rental contract/renting the bikes must be over 18 years old. Under aged customers must be accompanied by an adult. 

  4. On confirming the booking of the bike rental, the customer accepts this rental agreement.  At the end of the rental period, the customer accepts the charges for any missing or broken items at market prices, which will be charged to their credit card. The deposit will be refunded if the rented equipment is returned in the same conditions it was procured. If the missing or broken items exceed the deposit amount, the customer must settle the balance.

  5. CANCELLATIONS,  REFUNDS AND NO-SHOWS (BIKE RENTAL)

    Definitions and cancellation request
    For the purpose of this agreement, the “Start Date” refers to the scheduled date and time of bicycle delivery and/or pick-up (“programmed delivery time”).
    All cancellation requests must be submitted in writing (email is acceptable) and will be considered effective on the date and time they are received by Go Cycling Portugal.

    Refund policy based on notice period (calendar days)
    In the event of a bicycle rental cancellation, the following refund conditions apply, calculated in calendar days prior to the Start Date:

    • 120 days or more before the Start Date: 100% refund of the amount paid

    • Between 119 and 90 days before the Start Date: 80% refund of the amount paid

    • Between 89 and 30 days before the Start Date: 60% refund of the amount paid

    • 29 days or less before the Start Date: no refund (0%)

    No-shows and failure to collect bicycles
    Reservation no-shows (failure to appear at the agreed time and place for bicycle delivery and/or pick-up) will be charged in full and are non-refundable.
    Date or time changes requested by the client are subject to availability and may be treated as a cancellation and new reservation, in which case this policy applies.

    Early return / unused services
    No refund or credit will be issued for early return of bicycles, partial use of the rental period, or unused services once the Start Date has commenced.

    Personal circumstances, weather and events beyond control
    The client understands and accepts that Go Cycling Portugal is not responsible for the client’s personal circumstances, illness, injury, travel disruptions, weather conditions, or any event outside Go Cycling Portugal’s direct control. Requests for refunds or credits for any of these reasons will be handled strictly in accordance with the refund policy stated above.

    Exceptions and force majeure
    Except where mandatory law provides otherwise, no exceptions to this cancellation and refund policy can be made for any reason. Force majeure situations will be assessed in accordance with applicable law, without prejudice to the terms of this clause.

  6.  

    REFUND PROCESSING
    Where applicable, refunds will be processed using the original method of payment. Any non-recoverable bank, payment processing, or administrative fees may be deducted from the refund amount.

 

RENTAL EQUIPMENT 

  1. “Go Cycling Portugal” confirms that all its bicycles are presented to customers in an immaculate working order set up by professional mechanics and whilst “Go Cycling Portugal” accept general wear and tear during hire, any rental equipment returned with excessive cleaning needs will incur a 30€ charge to the client. Road bicycle rentals have a daily rate of 45EUR; Mountain and hybrid bikes rental have a daily rate of 30EUR; E-bikes rentals have a daily rate of 45EUR; Gravel rentals have a daily rate of 40EUR; E-road bike rentals have a daily rate of 90EUR – VAT already included.

  2. The rented bicycles and equipment may only be used by the designated customer and the members of his/her party as mentioned in the Rental Contract. 

  3. The customer is obliged to take good care of the rented equipment and to protect it from damage, loss or theft. In case of damage, loss or theft of the bicycle/s, components or any of its parts, “Go Cycling Portugal” will charge the customer the full cost of the missing items at market prices. 

  4. Bikes are rented with a security lock and the customer is obliged to lock the bicycle/s properly at all times when unattended, passing the lock through the frame and attaching the bike(s) to something fixed to the ground like a post or fence, if allowed, but preferably inside a closed bicycle parking. It is highly recommended to keep the bikes secured at all times especially during over‐night rentals, inside the property the client is staying in.

LUGGAGE AND PASSENGER TRANSFERS

    .16 "Go Cycling Portugal" only operates luggage or passenger transfers when included in it's bike rental or bike tour packages, under the following circumstances:

  • The client must ensure that in all hotels/accommodations there is a open reception from 09:00 to 16:00 (local time) and with access to vehicles such as cargo vans, so that we can pickup and deliver the luggage without problems or delays. We do not perform this type of service in apartments and private locations, on upper floors with delivery/pickups in rooms due to difficult access or when itsn't possible to schedule a time for luggage pickup/delivery.If "Go Cycling Portugal" is prevented from accessing the luggage and/or bicycles at during the pickup, the service may not be made and there will be no refund.

  • Transfer execution hours are from 09:00 to 16:00 (local time). The client must leave the luggage at reception at 09:00 (local time), even if the client still remain at the hotel/accommodation. If the luggage is not ready for pickup from 09:00 (local time), on the date indicated by the customer for the pickup, a fee for new pickup attempt may be applied. Isn't possible to schedule a time for luggage pickup/delivery.

  • What we transport and consider luggage are Cabin, medium and large bags, backpacks, softbags, similar bags similar - Bicycle bags require prior confirmation, due to the type of volume. We do not transport items unattached from suitcases, Shoes, food and drinks, plastic bags, umbrellas and electronic devices, such as laptops (we are not responsible for damages that may be caused by carrying them daily).

  • We do not authorize locators in luggage, for privacy issues and security of vehicles/warehouses/drivers.

  • Bicycles are transported without boxes, we have various types of equipment and protective material, so that transport can be made in a simpler and safer way. Alongside the bikes, we can transport the material belonging to them, such as panniers (as long as they are empty), repair kits and helmets. We do not transport fixed or loose items on bicycles, such as plastic bags, or luggage.

  • Go Cycling Portugal is not responsible for lost items that are out of luggage, hanging on bicycles or because luggage is not properly closed. Go Cycling Portugal is not responsible for damage to sensitive and/or electronic items, such as laptops.

LIMITATION OF LIABILITY 

  1. “Go Cycling Portugal” has procured itself with proper third party liability insurance coverage of the bicycle rental activity. “Go Cycling Portugal” is not responsible for injury or damages caused to/by the client during the hire period. 

  2. The customer is responsible for adequate personal insurance coverage for risks that may occur during the rental period. “Go Cycling Portugal” is not liable for any claims for body injury or harm, accidents or loss of personal belonging caused by weather, sickness, or any other causes whatsoever beyond the control of “Go Cycling Portugal”.

  3. The customer and his/her group must respect Portuguese traffic regulations. Any ticket or fine due to incorrect use of the bicycle will be completely assumed by the customer. 

  4. Exclusive place of jurisdiction shall be Lisbon, Portugal. This contract shall be governed by Portuguese law.
